The Association provides its beneficiaries, representatives, partners, and members with a semi-public resource portal and an Intranet that allows them to collaborate remotely. While the Association aims to share as much useful information, educational models, and ideas as possible with the educational and scientific communities, it is aware that making all produced and available information immediately accessible would hinder its future development and thereby limit its potential to contribute to the education and scientific research communities. For this reason, users of the Intranet sections are expected not to share the information contained therein and to treat it as confidential until the Association’s Management makes it available to everyone by publishing it in the public area of the site.

By using this portal, each user agrees to comply with the rules governing the use of the Intranet and the general editorial area of the site.

 User Account

Phone numbers, email addresses, postal addresses, birth dates, and all other contact and CV details must be completed in the account creation form.

Additionally, it is mandatory to upload a portrait or situational photograph to your user profile.

Failure to do so may result in account deletion.

 Confidentiality

As part of your participation in the Association’s activities, you will provide your thoughts and contributions to the Association’s scientific, technical, and educational work. During these activities, the various parties with whom you interact will share strategic and confidential information due to its personal nature.

You agree to treat this information as confidential, with the same care as you apply to your own confidential information. You will refrain from any direct or indirect use or exploitation of this information for any purpose other than the development of the projects you work on with the Association. You will only disclose received information to those independent collaborators who must necessarily know it (such recipients will then automatically be considered by the Association to have accepted the same confidentiality obligation towards you), and will not disclose this information to any third party, whether directly or indirectly, without the prior written consent of the party that provided it.

All information on the Association’s Intranet, including that related to the public, suppliers, partners, or other organizations or individuals associated with the Association, or regarding the Association’s present, past, or future projects, is also considered confidential.

These confidentiality obligations do not apply to information that was publicly known or generally accessible at the time of communication or that becomes public and generally accessible by its original owner, whether through publication or another method, without any fault or omission on your part.

Additionally, you acknowledge that the provision of confidential information to you does not in any way grant you a license or usage rights.

 Ownership

The Association holds exclusive ownership of all elements and products you have created on this resource portal as part of your missions within the Association and, more generally, as part of your team work, including documents (articles, photographs, plans...) or objects, whether you are an active member, partner, or beneficiary member.

 Ownership of Names and Trademarks

The Association owns all names and designations “Objectif Sciences International,” “Objectif Sciences International ZONE,” “Objectif Sciences ZONE,” “Objectif Sciences International COUNTRY,” “Objectif Sciences COUNTRY,” “Objectif Sciences International REGION,” and “Objectif Sciences REGION,” where ZONE, COUNTRY, and REGION are replaced by all zones, countries, and regions worldwide. For example: “Objectif Sciences International South Pacific,” “Objectif Sciences South Pacific,” “Objectif Sciences International Tahiti,” “Objectif Sciences Tahiti,” “Objectif Sciences International Huahine,” and “Objectif Sciences Huahine,” covering all countries globally, in all languages or dialects, including approximate formulations.

The Association also owns all other network-specific names and designations used on this Intranet.

The use of these names is authorized and required for all members and representatives in performing their functions within the Association.

 Intellectual Property

You acknowledge that any idea, plan, model, patent, or trade secret developed through one or more actions of the Association, consecutive or otherwise, belongs to the Association. You are the author or co-author, and your contributions are listed among the creators of the document. However, ownership resides with the Association.

The Association commits to promoting and enhancing these ideas, plans, models, patents, and trade secrets to ensure their development.

The Association also commits to protecting the interests of inventors and those who contributed to the emergence of these ideas, plans, models, patents, or trade secrets, and to remunerate them proportionally to their initial contribution from material, intellectual, or financial revenue generated through media, commercial, intellectual, industrial, or other enhancement of these ideas, plans, models, patents, or trade secrets.

 Assignment of Intellectual Property Rights

By acknowledging these terms of use, you agree to fully and permanently transfer all of your economic rights to OSI for any intellectual contribution made within OSI, its websites, or any of its Scientific Stay Centers.

As such, you agree not to claim any additional compensation for any reason.

Consequently, OSI acquires, definitively, ownership of all rights to represent and reproduce your contributions made on its behalf.

OSI may freely:

  • Reproduce the creations, analyses, or work in any quantity it wishes, whether associated with other creations or not, on any medium, including but not limited to mineral, vegetal, animal, synthetic or composite materials, such as paper (newspapers, weeklies, magazines, catalogs, brochures, leaflets, flyers, mailings, displays, windows, advertisements, posters, cards, boards, signs, educational, scientific, promotional, or commercial publications), metallic, plastic, synthetic or blended fibers, film negatives, slides, digital or opto-digital media (websites, databases, CD-R, DVD, floppy disks, etc.).
  • By any technical process, including but not limited to printing, reprography, engraving, photography, holography, molding, graphic arts, mechanical recordings, magnetic, digital, IT, or cinematographic processes;
  • Display the creations, analyses, or work by any means, including but not limited to public display, projection, transmission, or broadcasting by any telecommunication method of sounds, images, documents, data, messages, and announcements, including radio, cable, satellite broadcast, paid or free TV, encrypted or not, interactive kiosks, mobile or fixed phones, computers, or terminals connected to any database, by networks such as the internet, intranet, extranet, etc.;
  • The right to select, enrich, modify, transform, adapt, use as-is, or integrate, with or without modification, all or part of the creations, analyses, or work completed by the employee for OSI;
  • The right to assign the benefits of this assignment to any third party of its choice.

This assignment is granted worldwide for the legal duration of copyright protection. The assignment, as defined above, is final, and the termination of any agreement or contractual relationship, for any reason, shall not affect the scope and duration of this assignment.

Additionally, you retain the moral rights you may hold over work completed for OSI.

You guarantee OSI that you hold all rights to your work, including intellectual property rights. You guarantee that it does not constitute infringement and that this assignment does not violate any third-party rights. You generally guarantee OSI that nothing will hinder the free exploitation of all your creations, analyses, tasks, or work carried out for OSI.

Consequently, you indemnify OSI against any action, claim, demand, or opposition from any party invoking an intellectual or industrial property right or an act of competition and/or parasitism affected by this assignment.

Furthermore, you guarantee OSI that you have not and will not register any of the creations, analyses, or work created for OSI.

 Image Rights

You expressly agree that your name, image, professional background, and mission description may be used by OSI for internal purposes, including but not limited to the creation of a directory, internal brochure, organizational chart, or Association presentation, as well as for external use, such as in promotional brochures, informational materials on the Association, descriptions of the Association’s members, collaborators, employees, and website.

You expressly agree that OSI may use your name, image, and any description concerning you on any type of medium, physical (brochure, flyer, publication, newspaper, review, report, photograph, CD-R, DVD) or immaterial (internet, intranet, extranet), for a duration of ten years.

In return, OSI commits to respecting your image, not distorting it from the context in which it was taken, and not using it beyond the scope of its current statutes.

 Non-competition

As the Association’s goal is to promote Scientific and Technical Culture beyond its own activity, it does not object to any activity you create after starting to use this portal or to integrating an activity you managed previously, except if it involves unfair or parasitic practices, harms the Association’s goals, or copies our range of actions and services.

If such a similar activity already exists, you agree to inform the Association of its existence no later than upon your registration on this site, using the “comment” field in the registration form. If you decide to create one after registering on this site, you agree to notify the Association of your intentions at least six months in advance.

You may then establish a long-term partnership between the two activities to support the Association’s development.

 Non-solicitation of Personnel

By using this portal and registering as a user on this site, you agree not to directly or indirectly hire or engage any active member or employee of the Association. You agree to inform the Association in advance if you hire a beneficiary member or partner, including if they were met at an Association event.

If the hired person is a former employee who has previously resigned from the Association, recruitment is only authorized after a reasonable period, provided the resignation was not an indirect solicitation by the new employer.

This restriction is valid for the entire duration of your registration, plus an additional twelve months after its termination.

In case of non-compliance, you agree to compensate the Association by paying an amount equal to four times the last annual salary of the hired person. This amount is fixed, but the Association reserves the right to seek judicial compensation for the full extent of the damages if it exceeds this amount.

 Return and Use of Association Property

You expressly agree to return any materials and information entrusted to you no later than the day you effectively cease your activities on this portal and/or within the Association, regardless of the reason, without the need for a prior request or formal notice from the Association.

 Obligations

You agree for the entire duration of your use of this resource portal (up to written termination of this agreement) to comply with any instructions provided by the Association through its Management, Board of Directors, or President regarding the use of this portal, and to adhere to the rules governing its internal operation.

You also agree to notify the Association immediately of any changes in the situations you reported upon registration on this site (address, family status, military status, work availability, etc.).

The Association agrees to inform you of any changes in the situations it reported on this portal (office address, phone number, etc.) during your registration on this portal.

For all missions conducted for the NGO or one of its member organizations, you agree to become familiar with and comply with the internal regulations available on this site’s intranet.

 Duration

These provisions apply continuously throughout your registration.

However, any user may request to terminate their commitments to the Association.

The Association reserves the right to exclude any user who does not comply with these provisions or any other value upheld by the Association.

 Nullity

If any provision is declared void, illegal, or otherwise unenforceable for any reason by a judicial or other competent authority, a reasonable modification of that provision will be made to make it compliant.

Other provisions will remain unchanged.

 Jurisdiction

In the event of a dispute or the need for interpretation of this agreement by a third party, you and the Association agree that the Legal Forum of Geneva has exclusive jurisdiction as a last resort.

However, in cases of information theft, defamation, or other serious matters, you acknowledge from this moment that the Association may defend its rights at the court closest to your residence.

 Intranet Use

In the interest of transparency for users and to promote the fair, responsible, and secure use of the Intranet, these provisions establish the rules governing Intranet use.

Thus, unless otherwise stipulated, these provisions apply to all users of the Intranet system, regardless of their status. Network administrators may nonetheless assign access privileges to the Intranet.

The themes of discussion covered in the forums

Each forum is centered on a specific theme. We ask that you respect these themes.

Access and registration procedures for the forums

Each forum can be read by anyone registered on the Intranet, subject to their access rights. To contribute, you will be asked to register by providing your name and a password and to enter an email address (formatted as firstname.lastname objectif-sciences.com).

This registration allows other participants to recognize your contributions, thereby personalizing the discussions while also enabling contact without revealing your personal email address. Access to the Intranet is thus secured by login parameters (usernames, passwords).

These login credentials are personal to the user and must be kept confidential. They are primarily intended to monitor user activity.

Where possible, these credentials should be memorized by the user and not stored in any form. In any case, they should not be shared with third parties or be easily accessible. Ideally, they should be entered by the user with each access and not saved in the information system’s memory.

When chosen by the user, the credentials must meet a certain level of complexity and be changed regularly.

Rights and Responsibilities of Each Reader and/or Contributor

Messages posted by participants in response to articles express only their personal opinions. Each forum or Intranet publication administrator neither endorses nor disapproves of these comments and is not responsible for the content of messages that they have not authored.

Likewise, they attempt to remove any objectionable messages or those not compliant with the basic rules of open, constructive debate and our forum charter, although they cannot control all messages.

By posting a reaction or message on our discussion forums, you agree not to submit content or hyperlinks to content that:

a. Is of a commercial or promotional nature;

b. May be unlawful, defamatory, offensive, obscene, discriminatory, or threatening;

c. May harm the sensitivity of the public, especially minors;

d. Contravenes the spirit of the site and/or these provisions.

Finally, you authorize Intranet administrators to moderate, modify, move, or delete your message for any reason and in any way they see fit. They also reserve the right to exclude any member who does not comply with the forum usage charter.

Les propos tenus sur les forums sont donc publiés sous votre propre responsabilité. A ce titre, vous devez respecter les lois et règlements en vigueur et le droit des personnes. Ainsi, vous ne devez pas diffuser des messages violents, injurieux, diffamatoires, racistes, révisionnistes, faisant l’apologie des crimes de guerre, pédophiles, appelant au meurtre ou incitant au suicide, incitant à la discrimination ou à la haine ou dont le contenu reproduirait sans autorisation une œuvre protégée par la propriété intellectuelle (ex. articles de presse, message d’un tiers).

Moderation Practice

a) Forum

Each forum is moderated post-publication, meaning that all messages are read after they are published.

The moderator ensures that your contribution aligns with the discussion theme of the forum, complies with applicable laws and regulations, and facilitates constructive debate. The moderator reserves the right to refuse publication of redundant messages, promotional or advertising messages, or those that are contrary to public order or decency, violent, racist, revisionist, condoning war crimes, offensive or coarse, or infringing on copyright or related rights, database law, trademark law, right to privacy, image rights, or any other legislative or regulatory provision in force.

All published messages remain the responsibility of their author.

Readers may request verification of any contentious messages posted on the forums by contacting the moderator.

b) Publication

Each publication or article submission is moderated before publication, meaning that all messages are read before they are published.

The same procedures applicable to forums apply to the moderation of various publications.

Deletion of a Message by Its Author

If a message author wishes to cancel or delete it, they must make a request to the network administrator.

Disposition of Collected Information

Each forum or Intranet space retains and stores all data enabling the identification of message authors and archives posted messages privately. This information may only be communicated to a judicial authority upon request.

The content of messages may also be communicated, on an exceptional basis and following an anonymization process, to a scientific or academic research institution.

Intranet-Related Confidentiality

The user is responsible for maintaining the confidentiality of information in their possession. They must always comply with the legislation that protects intellectual property rights, the confidentiality of correspondence, personal data, automated data processing systems, image rights, and protects minors from harmful content.

Under no circumstances should the user engage in an activity that competes with the organization or could cause it any harm by using the information and communication system, including through the Intranet or the email address provided to them.
